This document discloses the privacy practices of TextMuse, a mobile application owned and operated by L.A. Loosh Industries, Inc. (collectively "TextMuse," "us," "we" or "our"). As part of the normal operation of TextMuse, we collect and, in some cases, disclose information about you. This Privacy Policy describes the information we collect about you, how TextMuse may use such information, and what may happen to that information. By using TextMuse, you expressly consent to our use and disclosure of your personally identifiable information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms of Use of TextMuse. TextMuse will collect, use, and disclose your personal information as described in this Privacy Policy.Minors
If you are a minor (under the age of 18), you can use TextMuse only with the consent and under the supervision of your parents or legal guardians. If you are a minor, please do not submit any personal information to TextMuse. IF YOU ARE 13 YEARS OR YOUNGER, PLEASE DO NOT USE TEXTMUSE FOR ANY PURPOSE. TextMuse is not intended for any children under the age of 13. We do not knowingly collect any information from anyone who is under 13 years of age. If we become aware that any individual under the age of 13 has provided us with information, we will take steps to remove such information and terminate the child’s account. If you are informed that your child has provided us with information without your consent, please contact us at support@textmuse.com.Information We Collect
Your Registration Information. To use TextMuse, you will need to provide your e-mail address. You may also register using our registration form, where you will be required to provide us with your contact information and certain other personal information, namely, your name, birth month and birth year. If you choose to register, you agree to: (a) supply the information requested in the registration process, (b) ensure that all the information you supply to us is accurate, and (c) update your personal information. You may choose not to provide us with any registration information. In such an event, you can still access and use some portions of TextMuse; however, you will not be able to access and use portions of TextMuse that require your registration information.Your Usage of TextMuse. We automatically track certain information about you based upon your use of TextMuse. This information may include the number of text messages you send, the time of day you send text messages, and feedback you submit. This information is compiled and analyzed on an aggregate basis. We do not collect information that identifies you as an individual.
Your Correspondence. If you send us e-mails, letters or other personal correspondence, or if other users or third parties send us correspondence about your activities or postings on TextMuse, we may collect such information into a file specific to you.
Our Use of Your Information
Internal Purposes. We use your information to conduct internal research on our users' demographics, interests, and behavior to better understand and serve our users. We may also prepare and keep statistical records and other data about you and other users of TextMuse. We may hire third parties to help us collect and analyze such data, and we may share such statistical data with third parties. Again, such statistical data will not specifically identify you or any other user. We use this information to help us make TextMuse more useful to users--to learn about the number of visitors to TextMuse, what part of TextMuse they are interested in, how long the use TextMuse, and the types of technology our visitors use.Promotional Use. If you opt-in, we may use your information to send you advertisements, promotions, and notices in relation to our marketing and promotional efforts, and to improve our content and services. We may further use your information to deliver to you third-party advertisements and promotions, our new services and promotions, and other information and notices.
Administrative Notices, etc. We may use your e-mail address and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of TextMuse.
Billing and Support. If you open a credit account with TextMuse, we may use your address and billing information to bill you and provide associated support.
Dispute Resolution. We use information we obtain from you to resolve disputes, troubleshoot problems and enforce our Terms of Use.
Our Disclosure to Third Parties
We use practices that are consistent with standards in our industry to protect your privacy. We cannot, however, promise that any of your information will remain private. For example, third parties may unlawfully intercept or access transmissions or private communications on TextMuse. We do not sell or rent any personally identifiable information about you to any third party. The following describes some of the ways that your personally identifiable information may be disclosed. Law Enforcement. We reserve the right at all times to disclose any information about you as necessary to satisfy any applicable law, regulation, legal process or governmental request. We reserve the right to fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting any content, or publishing or otherwise making available any materials on TextMuse. BY USING TEXTMUSE YOU WAIVE ALL RIGHTS AND AGREE TO HOLD US HARMLESS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY US DURING OR AS A RESULT OF ANY INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF ANY INVESTIGATION BY EITHER US OR LAW ENFORCEMENT AUTHORITIESAdvertisers. We disclose aggregate information about our users to advertisers and for other marketing and promotional purposes. However, we do not disclose any personally identifying information to any of these entities.
Third Party Suppliers. We may use third party suppliers to assist us in providing the content available on TextMuse. Whenever a third party supplier desires to collect information about you, you will be notified of the involvement of the third party supplier, and you will never be required to disclose any information to the third party supplier.
Use Limited to TextMuse-Related Communications. Because of the nature of the services offered on TextMuse, TextMuse allows you to access other users' contact information. You may use such information only for TextMuse-related communications. TextMuse-related communication expressly excludes unsolicited commercial messages. Therefore, you must not text, post, upload, link or otherwise use TextMuse in any manner for any unsolicited commercial purpose or endeavor, including the offering for sale of any products or services, or otherwise engage in any unsolicited commercial activity on TextMuse for any purpose, including, but not limited to, conducting raffles or contests, displaying sponsorship banners, soliciting goods or services, soliciting funds, advertisers or sponsors. In all cases, you must give users an opportunity to remove themselves from your database and a chance to review what information you have collected about them. In addition, under no circumstances can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure by you to such other user. Note that law enforcement personnel, our commercial program participants, and other rights holders are given different rights with respect to information they access.
Security. We use reasonable measures to maintain the security of your information; however, no company, organization, online community, or mobile application, including TextMuse, can fully eliminate security risks associated with your personal information. We will have no liability to you or to any third-party arising out of any such loss, misuse, destruction, or alternation.
Affiliates. We may share some or all of your personal information with our parent company, subsidiaries, joint ventures, or other companies under a common control ("Affiliates"), in which case we will require our Affiliates to honor this Privacy Policy. If the assets related to TextMuse are acquired by another company, that company will possess the information collected by us and it will assume the rights and obligations regarding your information as described in this Privacy Policy.
